Air Canada Loophole May Allow It To Deny Refunds For Covid-19 Flight Cancellations: Analyst

Air Canada has added new language to its terms and conditions that experts say could give it the legal right to refuse future refunds. Aviation expert John Gradek says the new refund exception uses what seems like a purposefully vague definition of the “force majeure” term. “They’re trying to be cute around COVID-19,” he said. Law professor Michael Geist said although refund promises may be used as helpful evidence by a customer trying to obtain a refund, in the end, it’s the tariff document that’s a legal contract.
